SOOP DMCA & Copyright Policy

SOOP places a high priority on respecting the intellectual property rights of others and expects our users to do the same. 

SOOP acts in accordance with the Digital Millennium Copyright Act of 1998 (DMCA). If you hold a copyright or have the authority to represent a copyright owner, and you believe that a third party is infringing on that material through SOOP services, please submit a notice that meets the DMCA's minimum requirements to dmca@sooplive.com. We will then proceed with appropriate action in accordance with the DMCA.

 

DMCA Notice requirements

You must include:

  1. A description of the copyrighted work that you claim is being infringed;

  2. A description of the material you claim is infringing and that you want it removed or access to which you want disabled and the URL or other location of that material;

  3. Your name, title (if acting as an agent), address, telephone number, and email address;

  4. The following statement: “I have a good faith belief that the use of the copyrighted material I am complaining of is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)”;

  5. The following statement: “The information in this notice is accurate and, under penalty of perjury, I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right that is allegedly infringed”; and

  6. An electronic or physical signature of the owner of the copyright or a person authorized to act on the owner’s behalf.

Submissions under this DMCA Policy should be sent to dmca@sooplive.com 

We will review your submission and take whatever action we deem appropriate under the DMCA, including the removal of the challenged content from the website. Furthermore, in appropriate circumstances, we may disable access or terminate the account(s) of the reported user(s).

 

DMCA Counter-Notice requirements

If an agreement cannot be reached with the reporting copyright owner, the content owner can submit a DMCA Counter-Notice to dmca@sooplive.com. To ensure the counter-notice is valid, it must comply with the requirements of the DMCA and include the following details: 

  1. URL(s) where the material that was the subject of the notification of claimed infringement appeared before it was identified, removed, or access to it was disabled

  2. Name of the claimant who submitted the notification

  3. Your SOOP channel name (e.g., sooplive.com/Username)

  4. Your full legal name

  5. Your email address

  6. Your full postal address (Street, Unit #, State, Mailing Code, Country)

  7. Your phone number, including International Code

  8. Verify these statements by including, and adding your name and signature.

 

Trademark takedown request requirements

If you're ready to report content on SOOP that you believe infringes your trademark, please ensure you provide the following details:

  • 1. Information about the original trademark, including a description if it's a logo.

  • 2. A list of countries where the trademark is registered.

  • 3. The registration number(s) of the trademark.

  • 4. A scanned copy of the trademark registration certificate(s) or a screenshot of the registration from the website or database of the relevant national intellectual property office(s).

  • 5. A declaration stating: "By submitting this notice, I affirm that I have a genuine belief that the reported use, as I have complained of, is not authorized by the intellectual property rights owner, its agent, or the law; that the information in this notice is accurate; and, under penalty of perjury, that I am authorized to act on behalf of the owner of the intellectual property rights in question".

Repeat Infringer Policy

Our Repeat Infringer Policy states that we reserve the right to suspend or terminate accounts if a user is found to be repeatedly infringing on intellectual property rights. In certain situations and at our discretion, we may also restrict access to the SOOP service or terminate accounts of users who blatantly violate the intellectual property rights of others, regardless of whether it constitutes repeat infringement. For instance, if a court determines that an account holder is an infringer, we may take action accordingly.
